What does it actually cost to pay the minimum wage in India, and which published number is right?

What is the minimum wage in India in 2026?

There is no single minimum wage in India in 2026. Each state notifies its own rate by skill grade and zone. As of September 2026, monthly minimums for unskilled work run from about $77 (₹7,410) in Rajasthan to about $255 (₹24,407) in Greater Bengaluru.

All of these rates sit under the Code on Wages, 2019, in force since 21 November 2025, which replaced the Minimum Wages Act, 1948. To know more, refer this guide to India's new Labour Codes.

So the real answer is always a state, a zone and a skill grade, never one national figure.

Why does India not have one national minimum wage?

Because the Code on Wages gives the job to the "appropriate government", and for a private office that is the state. The Centre fixes rates only for its own sphere, such as railways, mines and banking.

Is India's national floor wage legally binding?

No. The national floor level minimum wage of ₹178 a day (about $1.86), up from ₹176 in 2017, is only a recommendation to the states. Section 9 of the Code lets the Centre fix a binding floor, but none had been fixed as of September 2026.

A Central Advisory Board was constituted on 21 July 2026 to recommend a binding floor, and unions questioned its composition on 10 September 2026 (Business Standard).

What are the central government minimum wage rates for 2026?

The Chief Labour Commissioner's orders of 30 March 2026 set central rates from 1 April to 30 September 2026. Area A unskilled work pays about $8.64 a day (₹827). The next revision is due on 1 October 2026 and had not been announced as of 24 September.

Each rate is a basic wage plus a variable dearness allowance (VDA), an inflation top-up linked to the Consumer Price Index for Industrial Workers.

Central rates bind only central-sphere employers, and each assumes an eight-hour day; beyond it, overtime rules in India require at least twice the normal wage.

Which figure do you owe, the basic or the payable rate?

The payable one. Several states add a variable dearness allowance on top of a basic rate. Karnataka Zone 1 unskilled is ₹23,376 basic but ₹24,407 payable once the ₹1,031 monthly allowance is added, so paying only the basic figure is an underpayment.

It is the same split you see in any salary structure in India, where basic pay and dearness allowance sit apart from other allowances.

How do zones and cities change the rate?

Zones follow municipal boundaries, so one role can cost a fifth more within a state. Bengaluru sits in Karnataka Zone 1, Hyderabad in Telangana Zone I and Noida in Uttar Pradesh Category I. Tamil Nadu sets rates by job title rather than skill grade.

Which state rates changed most in 2026?

Haryana raised unskilled pay by about 35% from 1 April 2026, and Uttar Pradesh Category I by about 21%. Karnataka's 22 May notification raised rates by up to about 60% across 81 scheduled employments.

Karnataka employers challenged it, but the High Court refused interim relief, so the new rates apply (LiveLaw). Maharashtra's July to December 2026 rates include a ₹4,134 special allowance in every zone.

Which rates are stale or hard to confirm?

Delhi has not revised since April 2025, and a fake October 2025 order was disowned by the state, so ₹18,456 stands (Delhi Labour Department). Nagaland still pays its 2019 rate after its Cabinet returned a revision proposal in March 2026.

Assam, Kerala, Tamil Nadu, Chandigarh and Arunachal Pradesh publish rates by district, designation or PDF only. For those, confirm the figure with the state Labour Department before you finalize an offer.

When do these rates change next?

Most states revise the dearness allowance on 1 April and 1 October, while Maharashtra and West Bengal use January and July. Put those dates beside your India payroll deadlines, since the two run on separate clocks.

How does India's minimum wage compare with the US minimum wage?

India's central Area A unskilled rate works out to about $1.08 an hour, roughly 15% of the US federal minimum of $7.25. Even Bengaluru's rate, about $1.23 an hour, is under a fifth of it. But the statutory floor is not what skilled talent earns.

The average regular salaried worker in India earned ₹21,285 a month in 2025, about $222, according to the Periodic Labour Force Survey (PIB).

The minimum wage sets your legal floor, while market rates decide whether an offer is accepted.

How is the minimum wage calculated in India?

You match the employee to a state, a zone, a skill grade and a scheduled employment, then read the notified rate. Two conversions change the result: whether the figure is basic or payable, and whether it is daily or monthly.

The day count causes the widest error: a daily rate multiplied by 30 is about 15% higher than the same rate multiplied by 26, the basis the central order implies. On Area A unskilled work, that is about $259 against $225 a month.

The wage definition matters too. Under Section 2(y) of the Code on Wages, if allowances such as house rent exceed 50% of total pay, the excess is added back to wages for statutory calculations. That rule also shapes take-home pay in India.

The right figure is a notified rate, a day count and a wage structure, checked together.

Does India's minimum wage apply to remote, IT and contract workers?

Yes for employees. Section 5 of the Code on Wages gives every employee a right to the minimum wage, including remote, IT, software and BPO staff. The rate follows the state where the employee works.

What if a foreign company hires a remote employee?

A company in New York hiring in Bengaluru owes the Karnataka Zone 1 rate, like any local employer. Without an Indian entity, you meet that duty through an Employer of Record (EOR), which becomes the legal employer, pays in rupees and invoices you in dollars.

Are contractors and gig workers covered?

Genuine contractors are not employees, so the floor does not apply. A mislabeled contractor can be reclassified with back pay owed, and the test is in our guide to contractor vs employee in India.

Gig and platform workers sit under the Code on Social Security, where aggregators contribute 1% to 2% of annual turnover, capped at 5% of payouts to those workers. For fixed-term roles, read more on contingent employment in India.

If the relationship looks like employment, treat it as employment and pay at least the state rate.

What does an employee cost above the minimum wage in India?

Employers add provident fund, state insurance and gratuity on top of the wage. From 17 September 2026, the provident fund wage ceiling rose from ₹15,000 to ₹25,000 a month, the first change since 2014.

The change was notified as S.O. 5109(E), so September 2026 payroll uses ₹15,000 for 1 to 16 September and ₹25,000 from the 17th (National Law Review).

What happens if you pay below the minimum wage in India?

Paying less than the amount due carries a fine of up to about $522 (₹50,000) under Section 54 of the Code on Wages, and a repeat within five years can bring imprisonment. The penalties scale as follows.

The bigger risk is the claim. Under Section 45, the authority can order compensation of up to ten times the amount owed, and employees have three years to file. Labeling staff as contractors adds misclassification penalties in India.

In our experience, these underpayments are rarely deliberate: a wrong zone or a basic rate treated as payable, both easy to fix early.

What should your minimum wage compliance checklist include?

Two dates matter most: monthly wages are due before the 7th of the following month under Section 17 of the Code on Wages, and a departing employee must be paid within two working days.

Here is the list we run for every client workplace:

  1. Confirm whether the central or state notification applies.
  2. Record the zone the office sits in, and recheck it for every new site.
  3. Map each role to a skill grade, or to a job title in Tamil Nadu.
  4. Note whether the figure is basic or payable, and add the allowance.
  5. Diarize the April and October revisions, and accrue arrears when a window lapses.
  6. Pay monthly wages before the 7th of the following month.
  7. Settle exit dues within two working days, so a Friday exit is paid by Tuesday.
